RENTAL CONTRACT – TERMS AND CONDITIONS
1.The rental starts when the renter takes away the bicycle and/or other equipment away from the rental place.
2.At the end of the rental period, in the event of non-return of the equipment or non-payment/partially non-payment of an invoice, the customer becomes responsible for the equipment according to the article 1915 of the French Civil Code and does not have the right to use nor to keep the equipment. Its return becomes compulsory under the penalties provided for by article 408 of the French Penal Code.
Offering financial compensation does not erase the obligation to return the equipment. The rental stops immediately if it seems good to L'Étape des Pyrénées as soon as the tenant's property is put into legal settlement.
3.The equipment can only be returned during the store opening hours.
4.The rental is paid no later than when the equipment is returned to the store. Contracts lasting longer than 7 days can be partially paid on every end of the week. A rental is invoiced for a period 9-hour ; an extra rental period of 9hour will be requested if the equipment is returned late.
5.All invoices have to be fully paid, upon reception of the invoices for companies and at the counter for all other customers.
Non-payment of rental invoices on the due date will result, regardless of the method of payment provided, in litigation, and a compensation equal to 15% of the sum unpaid, in addition to legal costs and legal interest will be requested. For partial invoices, the penalties provided by the article 2 of these conditions will be added.
6. Conditions for the rental contract
Ø Minimum age: 18 years old or parents must be present
Ø Documents to be presented: an identity document (identity card or passport only), for certain expensive models, proof of address will be required
Ø For any rental a deposit will be required
The deposit will be returned to the tenant upon arrival of the equipment to the store in its original condition and without damage. It guarantees the successful completion of the rental, in particular the costs of repair, cleaning and replacement if necessary. It can compensate any debt that the renter can have towards the store.
7.Use of materials
Ø A check up of the bike is made together with the tenant on the first day before leaving the store with the bike. Any defects, scratches or malfunctions of the equipment must be declared before departure.
The renter will be responsible for all damages or malfunctions that the bicycle will have after he picks up the bike.
The renter must return the bike in the same condition in which he received it.
Ø The tenant acknowledges having the opportunity to personally check the equipment prior departure, to find them in accordance with his needs and in good working condition.
He certifies also that he is able to use it personally without endanger himself and third parties and he certifies to not let other persons not able to ride the bicycle use the equipment.
He also acknowledges his duty to check the equipment before using it and to notify any defaults he may have observed if necessary.
Ø The tenant is required to protect the rented equipment against any overload or possible degradation and to ensure that, if necessary, the maintenance of the equipment is done by a professional. For a long-term rental, he is required to carry out regular maintenance of the equipment according to the instructions that he acknowledges having received when signing this contract.
Ø The use of the material in the cases below is prohibited and constitutes a breach of contract:
- use for an illegal purpose or in an illegitimate manner,
- use when the equipment appears to be defective or dangerous,
- use by another person than the one on the rental contract and without the agreement of the store.
Ø If the equipment becomes defective or breaks down, the renter agrees to notify the store immediately. The store will immediately replace the defective equipment by a similar one.
Ø Etape des Pyrenees is not responsible for incidents, injuries or material damage that may occur due to a breakdown or for any other reason.
Ø There is no guarantee covering the risks of non-adaptation of the equipment to the specific needs and capacity of the customer.
Ø By express agreement between the parties, the loan or sub-letting of the rented equipment is strictly prohibited, except if the store agrees with it. The rented equipment is the property of L’etape des Pyrénées and cannot under any circumstances be transferred or given as a guarantee.
8.Responsibility of the tenant
Ø The tenant agrees to pay the cost of repairs and replacements of the rented equipment, whatever the cause, with the exception of those due to normal use. Repairs will be made exclusively by the store and the cost of will be covered by the customer. The store remains the sole judge of the need to repair an equipment or an accessory.
Ø Equipment that cannot be repaired must be compensated at the cost of replacing an identical new item.
Ø In the event of theft of the equipment, the store is asking the renter to provide, within 48 hours, the police report describing exactly and without ambiguity the circumstances of the theft. The store will then charge the customer for the cost of replacing the equipment into an identical one in new condition and reserves the right to refuse to rent to a person who has already been the victim of theft.
Ø The renter is supposed to return the equipment as clean as when he picked up the bike, except for soil due to normal use of the equipment. Otherwise, the lessor will invoice the cleaning without the tenant being able to invoke any guarantee following the subscription of an insurance.
9. Insurance
Ø L’Etape des Pyrenees always covers the cost of repairing or replacing parts as long as they correspond to a normal use of the equipment.
Ø Are the responsibility of the renter, the theft or loss of the equipment, the damage caused by: fire, water damage, intentional action to break, non-respect of the elementary rules of use of the equipment, the transport of the equipment, improper use, etc.), loss of accessories or items from the equipment/bike.
Ø From the moment the equipment is taken over by the tenant, the renter is responsible for damage and injuries caused to third parties by using the equipment.
Ø In the event of damage caused to the equipment or in the event of theft, and if the tenant is insured against these risks by an insurance that he has taken out outside the framework of L'Etape des Pyrenees, he has to pay back to the store the amount of compensation he has received from the insurance company, at the risk of being prosecuted for fraud.
10. Only the Commercial Court of Tarbes will be held to settle all disputes.
